cultural center at ground zero. michael smerconish and i will talk about this hot button issue. back to work already, sending a judge a new note and asking for new information. when will we finally see a verdict in this case? and we're going to several towns across the country and using google earth to bust homeowners for violations and finding them, if is crossing the line to use this technology to spy on people. well, some peel call it spying, we'll let you be the judge, you had to see this one coming, jetblue flight attendant steven slater now being pushed on a reality show. we begin with president obama in milwaukee, it's his first stop on a three-day five state campaign swing that will also take into los angeles, seattle, columbus, ohio and to miami. the president's trip is being overshadowed by the political

firestorm, after he stepped into the emotional debate over plans to build an islamic center and mosque, two blocks from the world trade center site here in new york. msnbc political director chuck todd is right outside where the president visited a couple of hours. you talked be it the desire for the white house to want to change topics here, but we know right now the hold is on this issue regarding the mosque. >> it is, and right now, i think in some ways they realize that. right now president obama is speaking at a fund-raiser for the mayor of milwaukee who is running for governor, tom barrett, but they don't want to add anymore fuel to this fire, that you want to use. they would like to see this simply at this point just go away. it's politically democrats are not happy about this. they're not happy that they're on the campaign trail and now

they're going to be asked. they love the fact that they had cover two weeks ago when you had robert gibbs saying this is a debate, this is an issue that needs to be settled locally in new york city. and that allowed for all of these other democrats to say similar things. so there have been some sort of conservative opinion, particularly newt gingrich who's thinking about running for president and sarah palin who have been trying to make this a national issue and democrats have been sort of ducking it. well now that the president has spoken out on it, democrats can't duck it and that is a concern politically among some democratic strategists. >> all right, chuck, thank you very much, and as you mentioned, president obama says the he believes who support the ground zero mosque or wrong, or at least they're not necessarily right. the president clarified his original comments saturday, saying, quote, i was not commenting and i will not comment on the wisdom of making a decision to put a mosque there. i was commenting very specifically on the right people

have that dates back to our founding. i'm joined now by nationally syndicated talk show host michael smerconish, we know what happened during ramadan, and here we are four days later talking about this story, why? >> unless we allow facts to get in the way, tamron, if you look at the speech itself, i have watched it and i read the transcript several times over. dare i say that there's nothing a rational person could find objectionable in this statement. it is a speech about religious toll lanerance and religious fr. >> the president had talking points from another cable network and a few conservative bloggers trying to get traction. 6 why go back and clarify if you know what you said on saturday was on the up and up. >> covering this subject extensively, people are already sort of lying in the sand on the

issue without regard for the verbiage, and time and again, i found myself tamron saying please tell me specifically what is it that you find objectionable in terms of what he said. >> what did they say they found objectionable. >> they're flummoxed when you talk about that objection. he could have said something about the wisdom of constructing the mosque in close proximity to ground zero or at least there could have been a line in the speech that could have said let me make very clear, as he said saturday morning, i'm not passing judgment on the wisdom of such a decision, but i just want to speak to the constitution. one other irony that i note, anding the critics of the president on this issue are the same individuals who time and again say he's tearing down the constitution and he doesn't respect the constitution. it is a heart felt defense of the united states constitution. >> how do they benefit these same people who say they want to grab back their country from this man who's a socialist who

doesn't respect the constitution, the president is citing our rights as americans, one that we should certain value, freedom of religion and practice it. how do the conservatives or republicans or whomever out there see that as a bad thing, how do they benefit from it? is it just the polling numbers and they hope sheer numbers of people will be against it on their snide. >> there are issues that drive people to go out and vote on election day. ten years ago, if same-sex relationships were to come up, that was going to drive people out to vote come held or high water. >> emotional topics, knee-jerk topics. >> that's been so much in the news that that draws largely a shrug of the shoulders, the opposition has really dissipated. this is a push button issue, this will drive people to the polls and chuck makes an excellent point saying that the democratic members of congress or those running under the

democratic umbrella have not had to weigh in because the president didn't weigh in and it was being portrayed as a land use issue only in new york city. now that's off the table and you can rest assured from every congressional debate. republicans and democrats will be asked to weigh in on the mosque. >> they're going to be weighing in on it and we'll see who chooses to run rather than weigh in. thank you, michael, i know you're going to be hosting hardball, you're filling in for chris matthews, that's at 5:00 p.m. eastern. breaking news out of arizona authorities and volunteers are search forgive a missing 4-year-old little boy. he went missing sunday afternoon. police say travis mitchell was playing with other children around 5:00 in the evening, he was not with those children, though, when they returned home. the search is taking place in payson, arizona. that's about 90 minutes north of phoenix. travis is the third arizona

toddler to be reported missing in recent weeks. you might call the body of 2-year-old emmett track was found a mild from his home just hours after he disappeared. and 2-year-old syler newton vanished from a camping site in rim rock and he is sadly presumed dead as well. and update now on the deadly racing crash in the california desert. four victims right now remain in the hospital in stable conditions, two days after an out of control truck plowed right into a crowd during an offroad race. this home video shows the exact moment of that crash, eight people died and 17 others were hurt. the fans were so close to the tracks, they could actually reach out and touch the trucks after the crash. the driver had to flee the scene because some spectators were so angry they started throwing rocks at the guy. the driver's facebook page says he is devastated by the didn't.

mara, i understand the california highway patrol does not plan to arrest the driver. >> reporter: here's the thing, tamron, it's not clear that the driver did anything wrong. the organizers of this ez events set up rules and regulations and then they operate within them. it's largely a self-governed kind of thing, so if they didn't set up any rules that said there had to be barriers, that the crowd had to be a certain distance away or limiting the speed of drivers going over certain jumps, it was a competition and that may have led to this tragic accident, so officials are saying they have no plans at this time to arrest him or charge him with anything. in terms of the investigation, the way this works is if the bureau of land management issues a permit, because these things take place on federal land and then the organization decides what rules they want to ourpt under. in this particular case, there

may have been no official wrong doing. however that may move forward after a change of this magnitude. in terms of the driver, i have spoken to people who were at the event and they don't blame him and they also don't think that necessarily there need to be changes to the sport because they understand the dangers involve and they say the thrill and the excitement is part of the reason that they like the sport so much. i spoke to a woman earlier today whose husband was injured, his neck was broken, he's recovering from that, he's expected to make a full recovery and her two kids were also injured with nonlife-threatening injuries and she says she does not blame the driver. >> i feel bad for him, i feel really bad for him. he's probably a mess to know what happened, i'm sure that he's a mess, my heart goes out to everybody, everybody that lost somebody, we're blessed, we're very blessed and blessed that my husband and my kids came out of this.

>> reporter: now because of the fatalities that were suffered here at this event, officials are involved, they are investigating. there was a dashboard camera on the car that was in question so they are looking through the evidence to see itch there was any wrong doing, but at this point, it's not clear that anybody broke the rules, but rules may be changing in the future. >> and more heavy rain has been falling today in pakistan, the site of an enormous humanitarian crisis, the worst flooding in that country's history started more than two weeks ago and it spread throughout the region. some 20 million people have been affected and officials estimate more than 1,600 people may have died. it is feared that cholera now will spread. there's been at least one case reported and confirmed. meantime survivors say international aid is not arriving fast enough. the u.s. military has been helping with relief efforts there. and in a new interview, defense secretary robert gates says he intends to retire next year.

jim miklaszewski obviously all eyes are on afghanistan and combat troops in iraq. the announce has been a surprise, what's the reaction? >> the secretary has made it clear that he wants to retire, and it was thought it would be sometime in 2011. but a couple of years ago when he was preparing to leave the bush administration, he said he wanted to turn the reins over. now he's talking about a viable strategy in afghanistan. he wants to make sure that pentagon spending is under control before he leaves in preparation for the inevitable budget cuts that are coming down the road as the nation struggles with the economy. he wants to be part of the military and be part of the selection process of a whole new

array of four star generals and admirals. so he's not going to leave quietly. in fact one pentagon official said he would like to retire, but he's not very good at it. he has tried before and has remained on the job. >> and mick, is there an obvious name that's come up? >> there are any number, but it it's so early. one of the deputy secretary of defense's, let me correct the record again, under secretary of defense for policy, is considered to be at the top of the list, although she'll deny it up and down if you ask her. >> a lot of time between now and then to cover. all right, mick, greatly appreciate it. we're just weeks away from the withdrawal of combat troops in iraq. and jurors in the rod blagojevich corruption trial are back and they are deliberates

welcome back, bill clinton hitting the campaign trail in florida this afternoon in a deadlocked u.s. senate race. clinton is campaigning for kendrick meek, the former president will speak at three events in fact tonight. meek says clinton's support on a scale of one to ten is an 11 for the campaign. meek is running against jeff green in next week's democratic primary. and the 13th day of jury deliberations is now under way

in a trial for disgraced illinois governor rod blagojevich and in the past hour the jury has had a new question for the judge. john yang has been following the trial from the very beginning, so what now do they want? >> reporter: they have just asked for the transcript of the testimony of one of the witnesses. bradley tough, he talked about a case involving a $2 million state grant to a school in rahm emanuel's congressional district. when rahm was asking why the money was being held up, tusk went to the government and said that he wanted the money held up until his brother ari emanuel held a fund-raiser for him. tusk testified he never passed that long to rahm emanuel because he thought it was unethical. now the jury wants to see the transcript of that testimony, the judge has agreed so they'll

get that sometime today probably. so this suggests that they're still working their way through these charges. last week they told us they had two verdicts on two of the 24 charges at unable to agree on is 1 and we're still haven't even voted on 11 others. so they're still working their way through the charges, tamron. >> nbc's john yang live for us in chicago, keeping an eye on that jury, deliberating at 13 days. and the former illinois cop charged with murdering his third wife is sharing details about his life behind bars. drew peterson wrote a letter to the "chicago sun times," the paper printed parts of it on sunday, in the handwritten letter, peterson writes, quote, it's not easy being a national pass time. he writes about missing his children and how his fellow inmates even ask him for autogra autographs. he's still a key suspect in the disappearance of his fourth wife. over the next two weeks, the final u.s. combat troops will be

welcome back, we're watching stock where trading has fallen for four straight days last week. right now the dow down just seven points, s&p down and the nasdaq up as well at 11 points. gasoline prices dropped a couple of cents over the weekend. the average nationwide price of regular, it's now $2.75 a gallon. and now to iraq where the last 75,000 u.s. combat troops will leave in the next two weeks and that will end the 7 1/2 year

war. nbc news chief war correspondent richard engel joins us live from camp liberty where he's embedded in the last american combat unit in iraq, the fourth striker brigade. what's been the reaction from the striker unit. >> well, the striker unit clearly is very proud to have this position in iraqi history. they are stationed at ft. lewis in washington state and they will be the last american combat troops in iraq, when they leave, it's possible to say that the war is over, but what is clear to say and correct to say is that the combat mission will be over. 50,000 american troops will stay behind even after these troops from the striker brigade leave, but the combat mission won't be the same. it will be over. the troops that will be here will be on a training mission,

they will be with the iraqi security forces, but they won't be going out in fights, they will not be engaged in house to house clearing. >> as you point out, you're running some of the things that the 50,000 troops left behind will be responsible for, but then obviously that is still a very key responsibility in that country for them. >> it is a major responsibility, but the biggest problems right now are not with the iraqi security forces, that's primarily what the 50,000 american troops are going to be doing, training the iraqi police, army, helping them learn how to use new equipment, helping them use some of their supply lines and air assets. the biggest problem in this country right now is on the political side. even five months after national elections here, there is no new iraqi government and just today one of the major political parties here decided to end

negotiations with a political rival. today they're leaving behind a vacuum, leaving behind an individual government, and is considered one of the most corrupt in the world. >> let me ask you again, because you have spent so much time there and with the strikers, is it somewhat surreal at this point, as you point out the political aspect of this, the debate over whether we ever should have been there in the first place, is it all surreal for these men and women who are finally getting to come home? >> well, it is a time of excitement, i can tell you most of the soldiers here are already packed, they are just waiting to go. some have already been flying out, in the last several days and we have been broadcasting those pictures of soldiers sitting on the planes, thumbs up shouting out, we are on our way home. they all say it will only sink in once they get back to the united states. this is however a great time of

reflection, a lot of the soldiers here have been on multiple tours and when you look back at what they have done militarily, they toppled a dictator, saddam hussein in 2003. they stopped a civil war with the surge in 2007 and now they are leaving, the soldiers say with their heads held high. the failings largely on the political side and that is that they createded. if you ask many soldiers they would say that's not a military responsibility. we created a political state and the iraqis still must decide if they want to capitalize on that. >> they have done their job. thank you richard for making time to join us. thank you. it's a big day for shrimpers in the gulf, the commercial season is now officially under way, what the government and the seafood industry is doing to make sure the seafood is safe and trying to boost the confidence of consumers.

♪ j-e-l-l-o ♪ j-e-l-l-o [ child giggles ] good afternoon, i'm tamron hall, here's what we're watching right now on msnbc. right now president obama's headlining a fund-raiser from milwaukee mayor tom bat. it's the first on mr. obama's three-day campaign swing. earlier today t. 130 people survived a plane crash today, one person did die. there were eight americans on the boeing 737 that broke into three pieces upon landing, officials are investigating whether lightning struck that plane. and within the past hour, astronauts on board the international space station wrapped up a six-hour space

walk, they installed a new pump to fix the station's cooling system which broke down last week, nasa is hoping to have that system back up and running later this week. and some shrimpers are headed out this morning for the very first time since the oil disaster is started four months ago, today marks the opening of shrimping season, but the fear is no one will want to buy seafood pulled from the gulf. charles hadlock joins us live from venice, louisiana, so charles, i spoke to you a couple of hours ago, we were waiting to hear from the shrimpers what they thought of the catch of the day, i imagine they're still out there, what's the latest. >> reporter: they're still out there, we had one little small boat come back in, they're selling bait shrimp, they said the catch wasn't as good as you might normally expect from this time of year. but there's larger vessels looking for those large beds of shrimp. this is the first time that louisiana boats have been able to get back out on the water

shrimping since this disaster began five months ago this week. >> and charles, what's being done to try to reassure consumers, also the people who process seafood, restaurants who buy it, what's being done? are they planning on a campaign to try to get the word out that it is safe to eat? >> they ar trying to do that, the louisiana seafood industry along with the governor of louisiana are trying to get bp to finance a campaign an ad campaign nationwide to get people to buy gulf shrimp again and gulf seafood, according to the federal government, which has been inspecting the seafood for the last several months pulled from all sectors of the oil spill area, they have not found any evidence of any fish or shrimp contaminated with any drop of oil, that's the best news of all for the seafood industry, however everyone is skeptical after seeing months of oil on the surface of the gulf of mexico. they're waiting to see what the catch of shrimp looks like, and shrimpers are also curious about

what kind of price they can get. >> charles hadlock, live for us in venice, louisiana. the youngest survivor of last week's alaska plane crash is now out of the hospital. willie phillips was traveling with former u.s. senator ted stephens when that plane went down near an arkansas mountain. phillips is the son of lobbyist bill tip lips who died in the crash. four people survived the crash, five lost their lives including senator stevens. and on friday, the only man ever convicted in the lockerbie bombing will celebrate one year of freedom, megrahi was allowed to return to his native libya after his doctors said he just had a couple of months to live. now it's being reported that the right doctors didn't get asked the right questions. martin fletcher has the latest from london. >> one of al-megrahi's doctors said that he ought -- that's one

of four doctors who treated the libyan for cancer but were never consulted on whether he should be freed or not. he was released a year ago friday after the scottish government consulted other doctors and decided he could die within three months. they said it was impossible to make an estimate of how long he would live. according to libyan reports, shows no sign of dying any time soon. the british press is full of estimates that he could die soon after being released and there's speculation on why the scottish government was being found guilty in lockerbie scotland. 270 people died in that crash, mostly americans. shortly after he was freed, the libyan government signed a $900 million speculation agreement with bp and some are saying that had something to do with megrahi's release. that's being denied by bp, the

scottish government and libya. there is an economic milestone to report today, it's getting a lot of attention. china has surpassed japan has the world's second largest economy, that is bassed on the total of goods and services produced during the second quarter, it follows three decades of continues economic growth by china. the u.s. is still by far the world's largest economy, but expers predict china could pass the united states by the year 2027. and mel gibson making headlines again, and this time is not what you probably are thinking. it's apparently car crash, tmz.com is reporting that gibson crashed his maserati last night in malibu, tmz also reports that gibson lost control of his car and slammed into a rocky hillside. a malibu canyon road just last month, of course he made headlines when his alleged tapes showing mel gibson on a rant, sometimes racially abusive rants towards his ex-girlfriend were

made public. no word at least in this report on mel gibson's condition, but we can assume that he's okay. first snooki and then -- they're getting arrested left and right. let's get the scoop, courtney haslet is off this hour. here we got a little bit of fame, a little bit of cash for the first time in their life and they're getting in trouble. what is going on? >> they did get in trouble and ronnie is the latest. it's nothing as salacious as sn snooki was arrested on. >> it surprises me that he wasn't arrested for public drunkenness because this season he's drunk every episode. >> let's not forget, he was arrested during season one as well as for a fight outside a club. so he's no stranger, so we hear that he paid his fines and he was let go.

>> the next story, laurence fishburn's daughter, this has been a big tabloid story on the blogs, his daughter is 19 years old. her name is montana, she decided she waned to become a porn star because she said that she thought it would make her famous like kim kardashian. >> if that wasn't enough to make her father feint, now she's in more trouble. >> there have been some other charges last year that she was arrested for solicitation reportedly, but those charges have been dropped. now there are new charges stems from an incident last february. she allegedly broke a home of an ex-boyfriend's ex-and reportedly attacked her. she had been charged with i believe simple battery and trespassing and she had pled not guilty to those counts. now the prosecution wants to add two more counts into this, including assault with a deadly weapon and she's going to be going to a hearing on august 25. >> and laurence fishburn, a

great actor, all he's saying is that he's very hurt by this turn, absolutely. completely shocking. >> it is crazy shocking. >> the jeff blue floitblue flig who's been criticized for quitting his job in a cussing rant. he's been offered a reality show? >> if levi johnson can get offered a reality show, so can he. this was reportedly approached to his lawyer did stone entertainment. it's about steven slater helping unhappy workers quit their jobs in spectacular fashion, which could be pretty awesome must-see tv. this deal could get derailed. and he might learn that this whole story is not what it seems, he may not be the old folk hero that we thought he was in the first place. >> thank you, don, thank you.

a trial goes on in germany for a female pop star who has admitted to having unprotected sex despite being diagnosed with the aids virus. she is part of an all girl band called no angels. the 28-year-old was arrested

back in 2009, prosecutors say she had unprotected sex with three different men between 2000 and 2004. one of her partners is actually infected with hiv in 2004. and police in thailand have launched a massive man hunt for a kick boxer accused of killing a former u.s. marine. the two men reportedly got into a brawl at a bar and had to be separated. kick boxer followed him home and stabbed him with a knife. michelle segona joins us live from d.c. details of this story absolutely horrifying. but as i said, it started reportedly with a brawl of some sort, do we know anymore about why this started? >> well, i spoke with deshawn's first cousin. deshawn is actually from norman, oklahoma and what she told me was that her family was contacted on friday by the united states embassy and told

that he was killed and that there was a manned hunt to find his killer and also, deshawn was going to pick up his girlfriend, she was working at a local bar in the area when the suspect was blocking the entrance to the bahama and they sort of got into a fight inside of the bar, patrons broke it up and deshawn and his girlfriend left, they went back to the hotel where they were standing and when he left later on that evening to go to a convenience store, that's when he was stalking him. he was stabbed and died there at the scene. >> do we know any more about this kick boxer? there's a lot of this stuff on youtube, but if the accounts are correct, he had a reputation for picking fights. >> that's what we have learned. there's a lot of reports that a lot of folks in the community have spoken out to say that he was extremely aggressive, not just with other people that he met and not just the fighting world, but also with his

girlfriends, again, those are just reports and also that he could be possibly running out of money on the lam, doing things to be able to keep, you know, keep in hiding, possibly stealing, so these are some things that investigators are looking in on at this particular time. >> michelle, do investigators believe he's still in thailand, given that he's short on cash, how far could he really get? >> it's possible, at this particular point, it's possible he could be anywhere. and also we really want to be able to get some justice for deshawn in this. deshawn's family is working with the united states embassy to be able to bring his body over here for a proper burial. he is a purple heart recipient. >> thank you very much, michelle. >> and before i go to break, i want to take a moment now to thank all of those who participated in our special week long coverage here on msnbc of america's education crisis. it culminated yet in a two-hour special called making the grade that i was lucky enough to host

mcchrystal has accepted a new job as a lecturer at yale university. those are the things we thought you should know. today and in today's crossing the line, surveillance cameras are everywhere and they can pretty much capture anything. for example, in one long island town, officials use google earth to identify 250 homes where residents fail to giver building permits for their swimming pools, is it crossing the line when authorities use services like google earth to figure out if homeowners are breaking the law? gregory nodime is senior -- what are we to make of this. i don't imagine that google earth and others anticipated that google earth would be used this way. >> goinged put this is information out there and lets

whoever looks at it use it the way they want to. i don't think there's a congressional issue here, i think there is an issue about the kind of society we live in and whether we want the laws to take better account for technology as it advances. >> the satellite images and i even looked up a couple of places familiar. you can see the number of cars some people have on their property. and we looked at brush growing near homes that could contribute to wildfires as a way to keep track of whether people were tending to their lawns and areas around their homes. >> i think we have to think about how this information might be used and what would be permissible and what wouldn't. so for example, i could imagine there being a law that says it's okay to look down at a house once. see what's going on once. but that it's not okay for there to be constant con moring of that home by satellite. i could imagine a law that's like that. in this case, though, the information was out there publicly.

and the police used it, like they would use a newspaper for example. >> and that's what some of these municipalities are saying, hey, this is information that's out there, it's public, we're not actually spying or peering over someone's fence, but you've got nine potential class-action suits in the united states against google. we mentioned this is not just a concern in the united states. officials in greece are also using satellite images to bust people who have been tax evaders in this country. >> we're facing these issues by privacy with in different kinds of technology. take your cell phone for example, it's probably broadcasting your location every few seconds to a tower and that information is being stored. but the laws don't say what law enforcement has to meet. it's really important where there's not a constitutional issue involved. i think with location there is, but in cases where there might be a constitutional issue and
